The Application
The following link is an application for the petition of a Conditional Use, Rezone and Comprehensive Plan Amendment. Please fill out the only the parts that correspond directly with your project. Please note, no application shall be placed on any agenda, as an item to be acted upon, unless the Zoning Administrator has certified acceptance of a complete application. A notification will be sent to you once the application is determined to be complete.

Certified Survey Maps (CSM's)
All subdivisions of land within the Village of Weston and the Extraterritorial Zoning (ETZ) Area of the Town of Weston require either a Subdivision Plat or a Certified Survey Map to be submitted to the Village by a certified Surveyor for review. For land divisions creating up to three (3) child parcels AND a remnant lot require a Certified Survey Map. For land divisions creating more than three (3) child parcels a Subdivision Plat is required. Please see the process below.

Conditional Use
A public hearing is required. Notice of the time, place, and purpose of such hearing shall be given by publication of a Class 2 Notice in conformance with the requirements of Wis. Stat. § 62.23(7)(d). Said notice shall be sent to the applicant, owners of record of all lands within 300 feet of the boundaries of the subject property, and the clerk of any municipality whose boundaries are within 1,000 feet of any portion of the jurisdiction of Village of Weston and its Extraterritorial Zoning District at least ten days prior to the date of such public hearing.
Within 60 days after the public hearing, or an extension of said period requested in writing or electronic format by the applicant and granted by the Commission or Committee, the Plan Commission or Extraterritorial Zoning Committee shall take final action on the conditional use permit request. Any conditional use permits approved are recorded at the Marathon County Register of Deeds on the property.

Please note that in many cases, a pre-application conference is required prior to official submission of an application for conditional use, rezone or Comprehensive Plan amendment within the Village of Weston and the Extraterritorial Zoning (ETZ) Area of the Town of Weston. Rezone
A public hearing is required. Notice of the time, place, and purpose of such hearing shall be given by publication of a Class 2 Notice in conformance with the requirements of Wis. Stat. § 62.23(7)(d). Said notice shall be sent to the applicant, owners of record of all lands within 300 feet of the boundaries of the subject property, and the clerk of any municipality whose boundaries are within 1,000 feet of any portion of the jurisdiction of Village of Weston and its Extraterritorial Zoning District at least ten days prior to the date of such public hearing.
The Plan Commission (or Extraterritorial Zoning (ETZ) Committee for land in the ETZ Area of the Town of Weston) shall hold a public hearing on all proposed amendments to the Official Zoning Map. Following the public hearing, and after consideration of comments provided therein, the Plan Commission or ETZ Committee shall review the proposed amendment to the Official Zoning Map and shall within 45 days of the public hearing make a recommendation to the Village Board that the application be granted as requested, modified, or denied. If the Commission or Committee fails to make a recommendation within this time frame, the proposed amendment shall be forwarded to the Village Board without recommendation. Such deadline may be extended by written or electronic agreement from the applicant.
The Zoning Administrator shall schedule the proposed amendment for potential Village Board action. After careful consideration of all comments, the Village Board shall within 120 days of submittal of a complete application, act to approve or reject the proposed amendment, unless extended by written or electronic agreement of the applicant. Failure of the Board to act within 120 days of the submittal of a complete application (unless said deadline is extended by agreement of the applicant) shall constitute approval of the application as presented.
Temporary Zoning Permits and Certificate of Occupancy (Temporary Use)
This application is only required for certain temporary uses, as determined in the Municipal Zoning Code. Please review the table on the application to determine if an application is required. All uses indicated with a 'T' are permitted-by-right. This application also covers the use of a tent and temporary signs. Once the use is approved, Village Planning and Development Staff will supply you with permit and temporary certificate of occupancy.

Zoning Code Text Amendment
An amendment to the zoning regulations may be initiated by the Village Board, Plan Commission, by recommendation of Village staff to either of these two bodies, or by any member of the general public. Following acceptance of a complete application, the Plan Commission Recording Secretary, in coordination with the Zoning Administrator, shall schedule a public hearing before the Plan Commission, to be held within 45 days after acceptance of a complete application. Notice of the time, place, and purpose of such hearing shall be given by publication of a Class 2 Notice in conformance with the requirements of Wis. Stat. § 62.23 (7)(d). The Village Clerk in coordination with the Zoning Administrator shall also send said notice to the applicant and the clerk of any municipality whose boundaries are within 1,000 feet of any portion of the jurisdiction of this Chapter at least ten days prior to the date of such public hearing.

Zoning Permit and Certificate of Occupancy
This application must be filled out for ALL new businesses and Multi-family projects within the Village of Weston and the Extraterritorial Zoning (ETZ) area of the Town of Weston prior to opening for business. These applications should also be filled out for all new commercial tenants, a change in ownership or a use change to/within an existing building and business. The information collect will also be made public on the Business Directory for commercial occupancy only. A fine of double the fee will be imposed for all applicants that submit the application after occupancy so it is important you contact the Village prior to signing a lease or purchasing commercial property. Once completed and approved, Village Planning and Development Staff will supply you with the application for Certificate of Occupancy.
